ASSIGNMENT OF COPYRIGHT

Please read the notes overleaf and fill in, sign and return this form with your corrected proofs.

So that we can ensure both the widest dissemination and protection of material published in the University of Wales Press’s journals, we ask authors to assign world-wide copyright in both print and other media in their papers, including abstracts, to the University of Wales trading as the University of Wales Press (referred to here as ‘UWP’). This enables us to ensure copyright protection against infringement, and to disseminate your article, and our journals, as widely as possible.

1.       In consideration of the undertaking set out in paragraph 2, the Author as beneficial owner hereby assigns to the University of Wales the copyright in the Article entitled:

for the full legal term of copyright. So that there is no doubt, this assignment includes the right to publish (subject to paragraphs 3 and 4) the material in the article in electronic form; the Article may be published in printed, CD-ROM, microfiche, online, or in other form.

2.         UWP hereby undertakes to prepare and publish the Article named in paragraph 1 in the Journal.

3.       The Editor of the Journal and UWP are empowered to make such editorial changes as may be necessary to make the Article suitable for publication. Every effort will be made to consult the Author if substantive changes are required.

4.       The Author hereby asserts his/her moral rights under the Copyright, Designs and Patents Act 1988 to be identified as the Author of the Article.

5.       The Author warrants that the Article is the Author’s original work, has not been published before, and is not currently under consideration for publication elsewhere; and that the Article contains no libellous or unlawful statements and that it in no way infringes the rights of others, and that the Author, as the owner of the copyright, is entitled to make this assignment. If it contains material which is someone else’s copyright, the Author warrants that he/she has obtained the unrestricted permission of the copyright owner (please attach evidence of this) and that the material is clearly identified and acknowledged within the text.

6.       If the Article was prepared jointly by more than one author, the Author warrants that he/she has been authorised by all co-authors to sign this agreement on their behalf.

ASSIGNMENT OF COPYRIGHT: EXPLANATORY NOTES TO AUTHOR

The policy of the University of Wales Press is to acquire copyright for all contributions, for the following reasons:

1.       ownership of copyright by a central organisation helps to ensure maximum international protection against infringement;

2.       requests for permission to reproduce articles in books, course packs or for library loan can be handled efficiently and with sensitivity to changing library and reader needs. This relieves authors of a time-consuming and costly administrative burden.

3.       the growing demand for research literature to be delivered in electronic form, whether on CD-ROM or online, can be met efficiently, with proper safeguards for authors, editors and journal owners.

There are opportunities to reach institutions (eg, companies, schools and public libraries) and individual readers that are unlikely to subscribe to the printed journal. The University of Wales Press works with other organisations to publish, where appropriate, on CD-ROM or in on-line services, or to deliver copies of individual articles. It has also registered the Journal with the Copyright Licensing Agency, which offers centralised licensing arrangements for photocopying. Income received from all of these sources are used to further the interests of the Journal.

Your Article will be published in conventional printed form in the Journal, and will be stored electronically to enable the University of Wales Press to publish the journal on-line, in order to meet increasing library and faculty demand, and to deliver it as an individual article copy or as part of a larger collection of articles to meet the specific requirements of a particular market.  Assignment of copyright signifies agreement to the University of Wales Press making such arrangements.

It may be that the Author is not able to make the assignment solely by him- or herself:

1.       If it is appropriate, the Author’s employer may sign this agreement. The employer may reserve the right to use the Article for internal or promotional purposes (by indicating on this agreement) and reserve all rights other than copyright.

2.       If the Author is a UK Government employee, the Government will grant a non-exclusive licence to publish the Article in the Journal in any medium or form provided that Crown Copyright and user rights (including patent rights) are reserved.

3.       If the Author is a US Government employee and the work was done in that capacity, the assignment applies only to the extent allowed by US law.

Under the UK’s Copyright, Design and Patents Act 1988, the Author has the moral right to be identified as the author wherever the Article is published, and to object to its derogatory treatment or distortion. The University of Wales Press encourages assertion of this right, as it represents best publishing practice and is an important safeguard for all authors. Clause 4 asserts the Author’s moral rights, as required by the Act.

The Journal will permit the Author to use the Article elsewhere after publication, provided acknowledgment is given to the Journal as the original source of publication.
